1. Acceptance of Terms

By accessing or using the Clothes-Rack.com website, creating an account, or renting/purchasing products from us, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.

These terms apply to all visitors, users, account holders, and anyone who engages with our website or physical store services. We encourage you to read through them carefully before proceeding.

In short: By using our services, you're agreeing to play by these rules. They're designed to protect both you and us. If anything is unclear, reach out — we're happy to explain.

2. Rental Agreement

When you rent a tuxedo or formalwear item from Clothes-Rack.com, you enter into a binding rental agreement. Here's what that means:

  • Rental period: The standard rental period is 4 days, starting from the pickup or delivery date. Your specific rental dates will be confirmed at the time of booking.
  • Eligibility: You must be at least 18 years old to rent from us. For customers under 18, a parent or legal guardian must create the account and assume full responsibility for the rental.
  • Identification: We require a valid government-issued ID and a credit card on file at the time of pickup.
  • Proper use: Rented items must be used for their intended purpose (formal events) and returned in good condition. You may not alter, modify, or damage the rented items.
  • Sub-renting: You may not sub-rent, lend, or transfer rented items to another person. The rental is tied to the account holder only.

3. Payments & Pricing

All prices listed on our website are in Euros (€) and are subject to change without notice. However, once you confirm a booking, the price is locked in for that order.

  • Payment methods: We accept Visa, Mastercard, American Express, PayPal, and SEPA bank transfers.
  • Deposit: A deposit of 50% of the total rental cost is required at the time of booking. The remaining balance is due at pickup.
  • Purchases: For outright purchases, full payment is required at the time of order confirmation.
  • Group discounts: Wedding party packages and group rentals qualify for automatic discounts. These are applied at checkout and cannot be combined with other promotions.
  • Taxes: All prices include applicable sales tax unless otherwise stated.

4. Returns & Late Fees

We understand that life happens and plans change. Here's our policy on returns and late returns:

  • On-time returns: All rented items must be returned by the specified return date and time. You can return items in person at our Auburn location or via our prepaid shipping label (if delivery was used).
  • Late returns: Items returned after the agreed return date will incur a late fee of €25 per day, up to a maximum of the full retail value of the item.
  • Extensions: If you need extra time, contact us before your return date. We'll do our best to accommodate your request based on availability.
  • Condition upon return: Items should be returned as they were received. Normal wear from a single event is expected and acceptable. However, significant stains, tears, or damage may result in additional charges.

Pro tip: If you know you'll be late, call us before the return date. We're much more flexible when you communicate in advance. Don't just ghost us — we get it, things happen.

5. Damage & Loss

We want you to enjoy your event without worrying about minor mishaps. Here's how we handle damage and loss:

  • Minor stains: Small, easily removable stains (from food or drinks) are covered under our standard rental agreement at no extra charge.
  • Significant damage: Large stains, tears, burns, or irreversible damage will result in a repair fee or replacement charge, depending on severity.
  • Lost items: If a rented item is lost or stolen, you will be charged the full retail replacement value. This will be charged to the credit card on file.
  • Protection plan: For an additional €15 per rental, you can add our Damage Protection Plan, which covers accidental damage up to €200. This does not cover loss or intentional damage.

6. Alterations & Fit

Getting the right fit is critical, and we take this seriously:

  • Basic alterations: Minor adjustments such as hemming pants or taking in the waist are included at no extra cost for rentals.
  • Timeline: Alterations require at least 5 business days to complete. Please schedule your fitting appointment accordingly.
  • Fit guarantee: If the item doesn't fit after alterations, bring it back and we'll make it right — no questions asked, no additional charge.
  • Purchases: For purchased items, alterations are available at a discounted rate but are not included in the purchase price.

7. Cancellation & Refunds

We understand plans change. Here's our cancellation and refund policy:

  • More than 14 days before rental: Full refund of your deposit. No cancellation fee.
  • 7–14 days before rental: 50% of your deposit is refunded. The remaining 50% is retained as a cancellation fee.
  • Less than 7 days before rental: No refund. Deposits are non-refundable within 7 days of the rental date.
  • Purchases: Purchased items may be returned within 14 days of delivery in original, unworn condition with tags attached for a full refund. Shipping costs for returns are the customer's responsibility.

8. Account Responsibilities

When you create an account with us, you're responsible for maintaining the security of your login credentials. Here's what you need to know:

  • Accuracy: You agree to provide accurate, current, and complete information when creating your account.
  • Security: Keep your password confidential. You are responsible for all activity that occurs under your account.
  • Notification: If you suspect unauthorized access to your account, notify us immediately at [email protected].
  • Account closure: You may close your account at any time by contacting us. We will retain certain data as required by law or for legitimate business purposes.

9. Intellectual Property

All content on the Clothes-Rack.com website — including text, images, logos, graphics, product photos, and design elements — is the intellectual property of Clothes-Rack.com or its licensors. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

Product images are for illustrative purposes only. Actual items may vary slightly in color, texture, or detail. We make every effort to represent our products accurately, but we cannot guarantee that your screen display will match the actual product exactly.

10. Limitation of Liability

To the maximum extent permitted by law, Clothes-Rack.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.

Our total liability to you for any claim arising out of or related to these terms or our services shall not exceed the total amount you paid to us for the specific rental or purchase at issue.

We are not responsible for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or supply chain disruptions.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law principles. Any disputes arising under or related to these terms shall be resolved exclusively in the courts located in Lee County, Alabama.

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will notify you through:

  • A notice on our website homepage
  • An email to the address associated with your account
  • An updated "Last updated" date at the top of this page

Your continued use of our website or services after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
